SHOOT TERMS & CONDITIONS

USAGE RIGHTS / OWNERSHIP

By booking a property shoot with Jacob Guthrie ("Photographer"), the client ("Client") agrees that all photos, videos, and related media ("Content") remain the sole property and copyright of the Photographer. The Client is granted a limited, non-transferable license to use the Content solely for the marketing and sale of the specific property captured. Redistribution, resale, or repurposing for other properties, services, or third parties is prohibited without written consent by the Photographer. The Client may not alter the Content in ways that misrepresent the original work. This includes, but is not limited to, the use of artificial intelligence to virtually alter, stage, or change the Content in any way. Photographer reserves the right to use Content for portfolio, promotional, or social media purposes unless otherwise requested in writing.

COMPLIANCE WITH ADVERTISING STANDARDS & LOCAL LAWS

The Photographer provides professional image and video editing services at the discretion of the client. The Client acknowledges that various jurisdictions, Multiple Listing Services (MLS), and regulatory bodies have specific and evolving rules regarding the disclosure of "digitally altered" images and videos. It is the sole responsibility of the Client to determine if provided images and videos require disclosure under local laws or guidelines. By accepting and using these images, the Client assumes all liability for the proper disclosure and representation of the property in all marketing materials, and agrees to not hold Jacob Guthrie or Framed by JG LLC harmless from any fines, legal actions, or disciplinary measures resulting from the publication of these images or videos.

GENERAL LIABILITY

Photographer is not liable for any injuries, damages, or losses incurred during the shoot. The Client is responsible for ensuring the property is clean, accessible, and ready to shoot at the scheduled time. 

SHOOT DAY TERMS & CANCELLATION

Properties are shot "as-is" and the Photographer is not expected to clean, de-clutter, or move items. Unexplained cancellations within 24 hours may result in a fee. It is strongly requested, but not required, that the homeowner be away during the duration of the on-site visit to ensure a seamless workflow for the Client and Photographer. If Photographer is responsible for opening, unlocking, preparing, and/or closing the property, additional fees may apply. If Client is not present at the time of the shoot, or during the full duration of the on-site visit, unless specifically noted in the pre-shoot form, the Photographer's personal choices are deemed "final." This includes, but is not limited to, the staging of furniture, lighting, angles, compositions, music choices, amount of images and/or videos delivered, and any other aspects of the Content. 

REVISIONS

Revisions are made at the Photographer's discretion, and extensive revision requests may result in additional fees. First round of revisions is typically free, and additional revisions are billed at $100/hour. The Client agrees to make payment in full upon delivery of the content.
